Terms of Service

These Terms of Service ("Terms") are an agreement between you and the team that runs Whalidate ("Whalidate", "we", "us"). They cover the website whalidate.com, the app at app.whalidate.com and everything they do for you (together, the "Service"). By creating an account or using the Service you accept these Terms, our Privacy Policy, the Risk Disclosure and the Billing and Refunds policy. If you do not accept them, do not use the Service.
1. What Whalidate is
Whalidate is software for copy trading on Polymarket, a prediction market. You choose which Polymarket wallets ("whales") to follow and set rules: which of their trades to copy, how much to put on each, when to exit and how much may be at risk. The Service then places orders that follow those rules.
You can run a strategy on paper, with virtual money and simulated fills, or live, with real money from a trading wallet the Service creates for you.
Whalidate is not Polymarket and is not affiliated with, endorsed by or operated by Polymarket. We are not a broker, an exchange, a bank, an investment adviser or a portfolio manager. Every trade the Service places follows rules you set; we do not decide for you which trades to make.
2. No advice
Nothing in the Service is financial, investment, legal or tax advice. Wallet scores, rankings, WhaleFinder results, presets, our research and our blog describe how wallets and strategies performed by our measures. They do not take your circumstances into account and are not a recommendation to trade. Past results of any wallet, preset or strategy, ours included, do not predict future results. Decide for yourself, and take independent advice if you need it.
3. Who can use the Service
To use the Service you must:
- be at least 18 years old and able to enter into a binding agreement;
- not be located in, or a resident of, a country or region listed on our Restricted Countries page;
- not be a person named on, or owned or controlled by a person named on, a sanctions list of the United Nations, the United States (OFAC), the European Union or the United Kingdom;
- use the Service for yourself only, with your own money.
You are responsible for checking that using the Service, and trading on prediction markets, is lawful where you live. We may refuse, limit or close an account if we have reason to believe it does not meet these conditions.
4. Your account
You sign up with an email address and a password. Keep your password and your email account secure, and turn on two-factor authentication. Anything done through your account counts as done by you, unless you told us it was compromised before it happened.
One account per person. Do not share your account, sell it or let someone else trade through it. Tell us at once at support@whalidate.com if you think someone else has access.
5. Your trading wallet
When you prepare live trading, the Service creates a wallet for you on the Polygon network. We hold the private keys of this wallet and use them to sign the transactions your strategies and your withdrawal requests call for. We do not use your funds for anything else, and we do not lend them or mix them with our own money.
We take reasonable measures to protect the keys and the systems that use them. No system is completely secure, and the Risk Disclosure explains what could go wrong.
Deposits
Send only the assets the app names for your deposit address (currently USDC or USDC.e on Polygon). Assets sent on another network, or tokens the app does not support, are not credited to your trading balance and may not be recoverable. A deposit counts once the network has confirmed it and the app shows it.
Withdrawals
You can withdraw available funds to addresses you add to your list. To protect you, the Service applies security rules, which the app shows before you withdraw. These currently include: a waiting period before a newly added address can be used, confirmation by a link sent to your email, a limit on how much can leave in any 24 hours, a pause on withdrawals after a password change, and a minimum amount. Money held in open positions becomes available once those positions are sold or the markets resolve.
Check every address before you confirm. Blockchain transfers cannot be reversed, and we cannot recover funds sent to a wrong address or network.
Holds and checks
We may delay or hold a deposit or withdrawal, ask you to verify your identity or the source of your funds, or refuse a transfer, where we reasonably believe it is needed to protect you or the Service, to comply with sanctions or other law, or to investigate fraud or a security incident. We will tell you when we do, unless the law forbids it.
6. Live trading
Going live is your decision. Before a strategy trades real money, the app shows you its paper record and its worst drawdown and asks you to accept that risk. From then on, the Service copies new trades that pass your rules with no approval per trade, until you pause or stop the strategy.
Copies are placed after the whale's trade and at the prices available on Polymarket at that moment. They can fill at a different price, fill in part or not fill at all. Your limits stop new trades; unless your rules say otherwise, they do not close positions that are already open. Pause, Stop and the emergency stop are always available in the app.
Paper results are simulated and are kept apart from live results. Live results can be worse than paper results.
7. Polymarket and other third parties
Live trades are executed on Polymarket and settle on the Polygon blockchain. Markets are resolved under Polymarket's own rules, through the UMA oracle. We do not control Polymarket, Polygon, UMA, the issuers of the stablecoins involved or any other third party, and we are not responsible for their actions, failures, outages, rule changes, fees or decisions, including how a market is resolved or whether trading in a market is restricted.
Trades placed for you pay Polymarket's own fees where Polymarket charges them.
8. Plans and payments
Paper trading is free. Live trading and higher limits require a paid plan. Prices are in US dollars and are shown in the app before you pay. Plans are paid in crypto through our checkout and cover a fixed period. They do not renew automatically: to keep a plan, you pay again. We take no fee per trade and no share of your profit.
Refunds are covered by the Billing and Refunds policy. If we change prices, the new price applies from your next payment.
9. Acceptable use
You agree not to:
- use a VPN, proxy or false information to get around our country restrictions or checks;
- use the Service with money that is not yours, or for someone else;
- use funds that come from crime, or use the Service to launder money or finance terrorism;
- use the Service for insider trading, market manipulation or any other conduct that breaks Polymarket's rules on market integrity or the law;
- open several accounts to get around plan limits or other rules;
- copy, scrape, resell or redistribute data from the Service in bulk, or use it to build a competing product;
- attack, probe, overload or reverse engineer the Service, or access it by automated means other than those we provide;
- break any law that applies to you.
10. Suspending or closing an account
You can stop your strategies and close your account at any time. Withdraw your funds first; open positions can be sold or held until their markets resolve.
We may suspend or close an account, or stop live trading on it, if you break these Terms, if the law requires it, or to protect other users or the Service. Unless the law requires us to hold them, you will still be able to withdraw your funds.
If we decide to shut the Service down, we will tell you by email at least 30 days in advance where we can, and give you time to close positions and withdraw.
11. Our content and your content
The software, design, text, scores and data compilations of the Service belong to us or our licensors. We give you a personal, non-transferable right to use them through the Service while these Terms apply. Public blockchain data stays public; what we own is our analysis and presentation of it.
If you send us feedback or suggestions, we may use them without any obligation to you.
12. The Service is provided as is
The Service, including scores, rankings, presets and paper results, is provided "as is" and "as available". To the extent the law allows, we make no promise that it will be uninterrupted, error-free or secure, that data shown is complete or current, or that any strategy will make money.
13. Limits on our liability
To the extent the law allows:
- we are not liable for trading losses, missed or delayed trades, lost profits or opportunities, or indirect or consequential losses;
- we are not liable for losses caused by Polymarket, the blockchain, oracles, stablecoin issuers or other third parties, by events outside our reasonable control, or by your own actions, such as sending funds to a wrong address or network or losing control of your email account;
- our total liability to you for all claims is limited to the greater of the plan fees you paid us in the 12 months before the claim arose, or 100 US dollars.
Nothing in these Terms limits liability that cannot be limited by law, such as liability for fraud, or for loss of funds in your trading wallet caused by our gross negligence or wilful misconduct. If you are a consumer, you keep the rights the law where you live gives you.
14. Indemnity
To the extent the law allows, you agree to cover our losses and costs from claims by others that arise from your breach of these Terms, your breach of law, or your misuse of the Service.
15. Changes to these Terms
We may change these Terms. For changes that matter, we will tell you by email or in the app at least 14 days before they take effect, unless a change is needed sooner for legal or security reasons. If you keep using the Service after a change takes effect, the new Terms apply. If you do not agree, stop using the Service and withdraw your funds.
16. Disputes
If something goes wrong, write to support@whalidate.com first. We will try to resolve it with you within 30 days. To the extent the law allows, claims must be brought individually and not as part of a class or group action.
17. Other terms
If a part of these Terms cannot be enforced, the rest still applies. If we do not enforce a right at once, we have not given it up. You may not transfer your rights under these Terms; we may transfer ours to another operator of the Service, and we will tell you if we do. These Terms, with the documents they link to, are the whole agreement between you and us about the Service.
